These are the general conditions under which we contract for and deliver our software development services. They apply to every engagement we accept, except where your project’s signed contract says otherwise. We wrote them ourselves, setting out how we actually work; they have not been reviewed by a lawyer, so they do not claim to be more than they are: clear conditions, put in writing before we start.

  1. 1.Who provides the service

Computronic Jota Systems is the trading name under which Kevin Jesús Damiano Huamán, a sole trader registered with Peruvian tax ID (RUC) 10704031047, based in Andahuaylas, province of Andahuaylas, department of Apurímac, Peru, provides software development services. We have been operating since July 2026. For anything concerning these terms or a project in progress, the written channel is computronicjota0406@gmail.com.

  2. 2.Which documents govern our relationship

Three, in this order: first your project’s signed contract; then the quote you approved, with its detailed scope; and last these terms, which cover everything the other two do not address. Where they contradict each other, the one earliest in that list prevails. This site’s privacy policy forms part of these conditions and applies to any personal data we process.

  3. 3.What services we provide

Development of web-based management systems, online stores, mobile applications and custom integrations between systems, together with deploying and launching what we build. Every engagement is bespoke and governed by the scope of its quote. We are not resellers of third-party software, we do not resell licences, and we do not provide services that require professional accreditation other than our own: no legal, accounting or tax advice.

  4. 4.Scope, quotes and changes

The scope of each project is that of its approved quote: what is included and, explicitly, what is not. Anything not listed there is new work, is quoted separately, and is not carried out until you approve it in writing. We quote it before doing it, never after. A quote is valid for the period stated in its own text; after that we may revise prices and timelines before confirming it.

  5. 5.Prices, currency and payment

Prices are stated in Peruvian soles (PEN) and in the currency in which the quote is issued; this site does not convert currencies or display exchange rates, so the amount you pay is the one on the quote, with no conversion on our side. Unless the quote says otherwise, the arrangement is 50% on approval and 50% on delivery; long projects can be split into more instalments tied to specific stages. Payment is made by bank transfer, Yape or Plin, and is evidenced by uploading proof of the transaction. We do not take payments through a payment gateway, we do not store card details, and there is no automatic or recurring charge: you start every payment yourself. Each proof of payment is reviewed by a person on our team and marked as verified; that review is manual, so a payment may take some time to show in your dashboard. Development starts once the deposit is verified and the signed contract has been uploaded and acknowledged.

  6. 6.Tax receipts and invoices

This site and its dashboard do not issue Peruvian electronic tax receipts (boletas) or invoices (facturas): what you see there is the record of your payments and the transaction proof you uploaded, which is not a tax receipt. If you need a boleta or a factura, ask for it when you engage us and we issue it through the appropriate channels under Peruvian tax rules, outside this website. To issue an invoice we need your complete billing details; without them we cannot issue one.

  7. 7.What we need from you

Content, access and decisions, on time. Specifically: the text, images and data that go into the system; access to any third-party services to be integrated; a contact person with authority to decide; and answers to the sign-offs we ask for. You are responsible for having the right to use the content and materials you give us, including images and trade marks. If you give us a third party’s content without authorisation, we will not publish it.

  8. 8.Timelines

The timelines in a quote are good-faith estimates, not guarantees of a result by a given date. What we do commit to is telling you as soon as we know something is going to slip, why, and whose delay it is. Timelines shift when what we are waiting for from your side — content, access, decisions, payments — arrives late, and we tell you by how much at the time. Nor are we responsible for delays caused by events outside our reasonable control: prolonged outages of third-party services, power or internet cuts, natural disasters, or decisions of a public authority.

  9. 9.Delivery and acceptance

On delivery we notify you in writing, and you have the period stated in the quote to review and flag anything that does not match the approved scope. Whatever does not match, we fix at no cost. If we receive no observations within that period and the system is in use, delivery is treated as accepted — which affects neither the warranty set out below nor, if you are contracting as a consumer, the rights the law gives you.

  10. 10.Code ownership and third-party licences

Once payment is complete, the code written specifically for your project, its data and its access are yours, and we hand them over. Until then we retain title and grant you only the right to use it in test environments. We reserve the right to reuse generic components, utilities and the general knowledge we gain — a contact form or a paginated table is not your business’s intellectual property — always without including anything that identifies your company or any information of yours. Third-party tools, libraries and services keep their own licences, which we cannot change; we tell you which they are and which carry a recurring cost payable by you.

  11. 11.Domain and hosting

The domain and hosting services are taken out in your name and on your payment method; we configure them. This is deliberate: you never depend on us to keep existing online, and if you decide to leave you take your site without asking permission. Renewing those services is your responsibility, and we are not liable for an outage caused by an expired domain or hosting plan, although we will tell you if we notice one.

  12. 12.Warranty, support and maintenance

We fix defects in what we delivered at no charge during the warranty period stated in the quote, counted from delivery. The warranty does not cover: changes to what you asked for, new features, faults caused by modifications another person makes to the delivered code, uses other than the one the system was built for, or interruptions of third-party services we do not control. Ongoing support and further development are not included in the development price: they are contracted separately and, if you take them, their conditions and response times are set out in writing in that quote.

  13. 13.Confidentiality

What you tell us about your business so we can quote or build is not passed on to anyone, including if we end up not working together, and the obligation continues after the project ends. Only the people who need your information to work on your project have access to it. We do not publish your project in our portfolio or use your name or brand as a commercial reference without your written permission: having built a system does not entitle us to use it as an advertisement. This duty does not cover what is already public, what we learn legitimately by another route, and what we are required to disclose by law or by a public authority.

  14. 14.Personal data

The personal data processed in your system is yours: you decide what it is used for, and we process it only on your instructions and in order to provide the service. The personal data you give us — contact details, complaint details, account details — we process in accordance with Peru’s Personal Data Protection Act (Law 29733) and its regulation, Supreme Decree 016-2024-JUS, in force since 30 November 2024, and with our privacy policy. You can exercise your rights by writing to computronicjota0406@gmail.com: we handle access requests within 20 working days and rectification, erasure and objection within 10 working days, which are the deadlines that regulation sets. If you consider that we have not dealt with you properly, you can turn to the National Authority for the Protection of Personal Data at the Ministry of Justice and Human Rights.

  15. 15.Acceptable use: what we do not build

We do not build anything illegal, nor anything intended to access systems that are not yours, extract data from other people’s sites without authorisation, impersonate a person or company, send unsolicited bulk email, or circumvent a third party’s security measures. Nor do we build systems that process personal data for a purpose Peruvian law does not permit. We reserve the right to decline an engagement and to tell you why; and if a project already under way turns out to have one of these purposes, we stop it.

  16. 16.Liability

We are liable for the work we deliver in accordance with what was agreed and with Peruvian law, and we do not limit our liability for wilful misconduct, gross negligence, or any loss the law does not allow us to exclude. Beyond that, our liability for a project is limited to what you have paid for it, and does not extend to loss of profit or indirect loss. No system is free of faults and this one is no exception: we do not guarantee uninterrupted or error-free operation, and we are not liable for failures of third-party services, for data loss where no backup plan was contracted, or for the effects of changes another person has made to the delivered code.

  17. 17.Termination

Either party may end a project by notice in writing. If you end it, the work actually carried out up to that point is settled and handed over; the deposit covers that work and is not refunded for the part already performed. If we end it for reasons not attributable to you, we refund the part of the deposit corresponding to work not carried out. We may suspend work — with prior notice — if an overdue payment remains outstanding or if we do not receive what we need from you to continue. Confidentiality, and your ownership of what you have already paid for, survive termination.

  18. 18.If you are contracting as a consumer

If you contract with us outside your business or professional activity, you are protected by the Consumer Protection and Defence Code (Law 29571) and by this site’s complaints book (Libro de Reclamaciones), which does not require you to create an account. We have 15 working days, with no extension, to answer a complaint — a deadline set by article 24 of that Code as amended by Law 31435 of 2022, which only pauses for up to five further working days if we formally offer you a settlement (Supreme Decree 101-2022-PCM). Nothing in a quote, in a contract of ours or in these terms can cut back the rights that law gives you, and if anything here contradicted them, it does not apply. You can also go to INDECOPI, whose official contact details are in our complaints book.

  19. 19.Changes to these terms

We may update these terms to reflect how we work or a change in the law. The version that applies to your project is the one in force on the day you approved its quote; a later change does not apply to you retroactively. The date of the last update is at the top of this page, and it is what makes it possible to tell which version was in force at any given time.

  20. 20.Governing law and disputes

Peruvian law applies. Depending on the case, our engagements fall under the Peruvian Civil Code rules on the provision of services — a services contract where our work is engaged for a period, a works contract where a deliverable result is engaged — and, where you contract as a consumer, under Law 29571. The courts of Andahuaylas, Apurímac have jurisdiction, unless the law imposes another venue because of your status as a consumer. Before anything else, we talk: the vast majority of disagreements are settled in a conversation where both sides want to settle them.

This document is informative and reflects how we work today. It does not replace legal advice, nor does it limit the rights Peruvian law gives you. If anything here contradicts your signed contract, the contract prevails.
